All users of Novastock livestock and farm management software/webapps, website and any associated services (as more particularly described below, collectively, the "Services") must review and accept this Terms of Service Agreement ("Agreement") prior to using such Services. Your acceptance will be deemed to occur on use of the Services. You should print or otherwise save a copy of this Agreement for your records.
All content included as part of the Services, such as text, graphics, logos, button icons, images, audio clips, and software, is the property of Novastock or its content suppliers and protected by international copyright laws. The compilation (meaning the collection, arrangement, and assembly) of all content of the Services is the exclusive property of Novastock and protected by international copyright laws. We explicitly do not claim any copyright over the content (data) submitted by our users.
No portion of the Services may be reproduced, duplicated, copied, sold, resold, or otherwise exploited for any commercial purpose that is not expressly permitted by Novastock. Novastock reserve the right to refuse service or terminate accounts, including, without limitation, if Novastock believes that user conduct violates applicable law or is harmful to the interests of Novastock.
Novastock does not claim ownership of the materials you provide to the Services or post, upload, input or submit (further referred as "User Input") to the Services. However, by posting, uploading, inputting, providing or submitting your User Input you are granting Novastock, its affiliated companies and necessary sub-licensees permission to use your User Input in connection with the operation of their businesses including, without limitation, the right to copy data for backup purposes. No compensation will be paid with respect to the use of your User Input, as provided herein. Novastock is under no obligation to post or use any User Input you may provide and may remove any User Input at any time at Novastock's sole discretion. By posting, uploading, inputting, providing or submitting your User Input you warrant and represent that you own or otherwise control all of the rights to your User Input as described in this section including, without limitation, all the rights necessary for you to provide, post, upload, input or submit the User Input.
Any personal information and User Input will only be disclosed when legally required to do so, at the request of governmental authorities conducting an investigation, to verify or enforce compliance with the policies governing our Services and applicable laws or to protect against misuse or unauthorized use of our Services, to a successor entity in connection with a corporate merger, consolidation, sale of assets or other corporate change respecting the Services.
Novastock reserves the right at all times to disclose any information as necessary to satisfy any applicable law, regulation, legal process or governmental request, or to edit, refuse to post or to remove any information or materials, in whole or in part, at Novastock's sole discretion.
We do not provide contact information to third party marketeers without your permission. We share your contact information with third parties only in limited circumstances where we believe such sharing is 1) reasonably necessary to offer the Services, 2) legally required or, 3) permitted by you. We do not provide your data (User Input) to third party marketeers under any circumstances.
Your User Input is always submitted at your own risk. We do our best to maintain the highest level of security, but please be aware that no security measures are perfect or impenetrable. Therefore, we cannot and do not guarantee that data you submitted on the Services will not be viewed by unauthorized persons. We are not responsible for circumvention of any privacy settings or security measures contained in the Services. You understand and acknowledge that, even after removal, copies of your data and personal information may remain viewable in cached and archived pages or if other users have copied or stored your data and personal information. Please do not use the Services for highly sensitive information such as credit card details, bank details, etc.
Novastock may use cookies to deliver core features, improve functionality, and/or improve user experience of the Services. By using the Services you consent to our use of cookies.
Your data may be removed after 6 months of inactivity. Inactivity means not making any updates to the cloud/offline storage database.

Novastock makes no representations or warranties of any kind, express or implied, as to the operation of the Services or the information, content, materials, or products included in the Services. To the full extent permissible by applicable law, Novastock disclaims all warranties, express or implied, including, but not limited to, implied warranties of merchantability and fitness for a particular purpose. Novastock will not be liable for any damages of any kind arising from the use of the Services, including, but not limited to direct, indirect, incidental, punitive, and consequential damages.
You assume all risk associated with the use of the Services, including without limitation all conduct associated with administration. In no event shall Novastock be liable whether in contract, warranty, tort (including negligence (whether active, passive or imputed), product liability or strict liability or other theory), for cover or for any indirect, incidental, special or consequential damages (including without limitation any loss of profits or data, business interruption, computer failure or other pecuniary loss) arising out of the use or inability to use the Services or performance of any related services, irrespective of even if Novastock has been advised of the possibility of such damages. Some countries or states do not allow the limitation or exclusion of liability for incidental or consequential damages, so the limitations or exclusions in this and the foregoing paragraph may not apply to you, but shall be subject to Australian and/or international laws on jurisdiction.
Novastock reserves the right to modify or discontinue all of its Services with or without notice to the user. Novastock shall not be liable to the user or any third party should Novastock exercise its right to modify or discontinue its Services. The user acknowledges and accepts that Novastock does not guarantee continuous, uninterrupted or secure access to our Services and operation of our Services may be interfered with or adversely affected by numerous factors or circumstances. Novastock reserves the right to make any changes to its Services at any time, including changing pricing and/or subscription structure.
